BANTA, Director <br />February 25, 1988 <br />Ms, Jenni Nylund-Naff <br />Nyland Ranch <br />Box 266 <br />Nuc1a, Colorado 81424 <br />RE: Nucla Mine Objection Letter to Permit Renewal #1, Permit C-81-008 <br />Dear Ms. Naff: <br />We have reviewed your February 11, 1988 letter addressing your objections to <br />Peabody Coal Company's (Peabody) renewal of their existing Nucla Mine permit. <br />This objection letter was received during the public comment period. Our <br />review of this letter indicates that some of your concerns are outside of our <br />jurisdiction, some of your concerns can now be addressed by the Division, and <br />some of your concerns require additional information. This is more <br />specifically addressed below following the same format of your objection <br />letter. <br />Your first objection pertains to damage occurring to the roads around the mine <br />caused by heavy equipment. This area of objection is outside of the <br />jurisdiction of the law we administer. tAay we suggest you take up this <br />concern with the Montrose County Road and Bridge Department. <br />Your second objection pertains to <br />mine caused by Peabody's blasting <br />within our jurisdiction. The Regulations of the Colorado Mined Land Reclamation Board <br />for Coal Mining, specifically Rule 4.08, address blasting requirements which <br />are intended to protect adjacent areas. Operators can only use a certain <br />amount of explosives based upon mathematical equations. As a further means of <br />protecting society, the regulations require an operator to conduct pre-blast <br />surveys for all areas requesting such a survey.
