In answer to <br />your first statement I hope you are now clear on the issue of BLM road access. <br />The BLM public access road has been recognized by BLM for more than 15 years. <br />The right-of-way road, in the process of being assigned to the Ute Mountain <br />Ute Tribe, is not an exclusive right-of-way. It is a right to use. I will <br />attempt to answer your questions as you numbered them. <br />1. The topsoil from Montezuma County (taken from near the M & M Truck Stop) <br />was placed on the "county" working area of the Stone Gravel Pit. <br />2. No BLM representative was on site when the material was removed. <br />3. No test was conducted by BLM for any hazardous materials. We have no <br />knowledge of any tests the county might have conducted. <br />4. It is not nornal procedure on public land for truck drivers to decide <br />where a load will be dumped. No-one from BLM gave them the permission <br />to place the stockpiled topsoil on public land. <br />5. Removing the material from the public land abated the situation. Had <br />Mr. Stone presented the need to DA1G for more topsoil,or the need for <br />fill for reclamation, they could have contacted BLM, and this material <br />could possibly have been used for those purposes. <br />In order to effeciently use our available human and monetary resources '.ve may <br />exercise discretion on responding to issues you raise.
