Hernandez
Mined Land Reclamation Division
1313 Sherman St., Rm. 215
Denver, CO 80203
Dear Mr. Hernandez:
~~~~ J~
~tl
~us13 ~ :..
bfINERAL & GE~1,,: ~r•,
We had read the reclamation project bid document for Sec. 24 prior to
the pre-bid meeting on July 28th, and we have re-read it since. We also
had two prior meetings in the area, one with Mr. Renner and one with Ms.
Begej, at which time we expressed our ideas of the work that needed to
be completed including cleaning up the various GEC residual waste such
as tires, oil drums, and concrete foundations. In our memory, about the
only portion of our desired work that was rejected was the back filling
of the exploratory pit adjacent to the east quarter corner of Sec. 24.
Page 6, paragraph 2A of the bid document states that concrete will be
moved from the shop area to the orphan pit.
With no further information available to us concerning the actual work,
we were completely surprised when Ms. Begej stated that she was not
going to move any non-coal waste and that she was not going to amend the
bid document in any way, despite the fact that the discarded tire that
started the disagreement was obviously GEC residual trash.
We would suggest that you meet with us at the site to delineate your
plans since it seems unlikely that it will be possible on paper to
identify each GEC item that should be removed. However, to satisfy your
request, we wish all GEC residual trash including but not limited to
tires, cable, oil drums, pipe, and concrete foundations be removed.
We wish the green needle grass be eliminated from the seed mixture with
an increase in the Western wheat grass of 1 lb. per acre. We wish the
coal waste to be covered with at least four feet of non-toxic material.
Finally, we reserve the right to make additional requests based on
possible new findings at the site or based upon interpretations of the
bid document that differ from ours if either should become known.
Sincerely,
W.D. Corley, Jr,v~ ~,
President
