SHELTON, Diroctor
Richard D. Lamm
Governor
June 15, 1984
T0: Bear Coal Company/File No. C-033-81
FROM: David C. Shelto~
RE: Field Visit on May 29, 1984
Flooding on the North Fork of the Gunnison inundated the sediment pond and
several other low-lying areas within the permit boundary, but no serious
damage was done. Bear Coal successfully prevented flood waters from entering
most of the site by berming along the edge of their property. It appears that
the Highway Department through the placement of new fill on the north side of
the North Fork, has effectively constricted the river and forced the river
over toward Bear's property. The river channel created by the highway work
was to handle the 100-year flood. It is unclear at this time whether it will
or not, but the Highway Department has not certified that it will carry such
an event. We need to contact the Highway Department on this problem.
There is some mine development waste (date of placement unknown) in the
low-lying areas of the Bear permit. My recollection is that such materials
were never to be placed in that part of the permit area because of the
potential hazard of high groundwater during flooding in unusual years. The
MLRD staff needs to check out this issue.
/mob
Doc. No. 2099
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel. (30:x) 866-3567
