• B. Rule 3.03.1(2)(a) Sixty Percent <br />Up to sixty percent of the applicable bond amount shall be released when the permittee successfully <br />completes backf~l[ing, regrading, and drainage control in accordance with the approved reclamation <br />plan. <br />This Rule refers to what is commonly known as Phase I of the bond release process. Colowyo <br />requests release of liability for Phase I work that meets this criteria in the Application. This <br />Application contains no request for a return of bond monies. The findings of an inspection and <br />evaluation of the degree of success in completing backfilling, regrading, and drainage control in <br />accordance with the approved reclamation plan is presented below under paragraph IV.A. <br />C. Rule 3.03.1(2)(b) Eighty-Five Percent <br />Up ro eighty-five percent of the applicable bond amount shall be released upon the establishment of <br />vegetation that supports the approved postmining land use and which meets an approved success <br />standard for cover. However, no more than sixty (60) percent of the bond shall be released so long as <br />the lands to which the release would be applicable are contributing suspended solids to streamflow or <br />runoff outside the permit area in excess of premising levels as determined 6y baseline data or in excess <br />of levels determined on adjacent nonmined areas; or until the essential hydrologic functions and <br />agricultural productivity have been reestablished on alluvial valley floors. <br />This Rule refers to what is commonly known as Phase II of the bond release process. Colowyo <br />requests release of reclamation liability for a part of Phase II reclamation work (replacement of <br />topsoil). This Application contains no request for a return of bond monies. The replacement of <br />topsoil portion of this request is evaluated in paragraph V.B below. <br />D. Rule 3.03.1(2)(c) Remaining Bond <br />The remaining portion of the bond amount shall be released when the permittee has successfully <br />completed all surface coal mining reclamation operations in accordance with the approved reclamation <br />plan, and final inspection procedures of 3.03.2 have been satisfied. This shall not be before the <br />expiration of the period specified for revegetation responsibility in 3.02.3. <br />This Rule refers to what is commonly known as Phase III of the bond release process. This <br />remaining portion of the bond is typically released in conjunction with a Phase III bond release <br />request. The Application addresses no Phase III bond release. <br />E.
