Kamnikar SEP 2 12700 <br />Division of Minerals and Geology <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 Division al Minerals and Geology <br />Denver, Colorado 80203 <br />RE: Response to Second Technical Adequacy Review for Amendment Application <br />001 to 112 Reclamation Permit No. M-1983-176, Speer Mining Resource, <br />Asphalt Specialties Co., Inc. <br />Dear Mrs. Kamnikar, <br />This letter is being written to address Adequacy Concerns raised by your office <br />concerning the Amendment Application 001 io Regular 112 Permit No. M-1983-176, <br />submitted by our client, Asphalt Specialties Company, Inc. <br />In a letter dated September 14, 2000, you acknowledged that Items 1, 2, 3, 4, 6, and 7 <br />DMG. According to the September i4'" letter, several concerns in the Amendment <br />Application remain. The following is the Applicant's response to the unresolved <br />Adequacy items. <br />Exhibit E -Reclamation Plan <br />5. DMG Comment: Concern was expressed over the fact that "the Operator has <br />changed the plans for reclamation of the site from the installation of a slung wall to <br />a clay liner." A question was raised as to whelher or not the Operator "wishes to <br />bond for the entire cost of the liner, without submitting specifications for its <br />construction.° Confirmation in writing, or submittal of technical specfications for <br />construction of the liner, was requested. <br />Response: In accordance wfth DMG Rules and Regulations, the Operator will bond <br />for the entire cost of the clakli~er. At this time, the Applicant is not submitting <br />specifications for construction of the clay liner. <br />8. DMG Comment: An issue was raised over the submittal and approval of a Voluntary <br />Clean Up Plan for the reclamation of areas on the permit site contaminated with <br />pesticides. DMG requested to review Colorado Department of Health and <br />Environment recommendations and the Applicant's proposed recamation <br />
