Cattany <br /> Acting Division Director <br />From: Tom Schreiner <br />Cc: Carl Mount <br />RE :Structure Agreements, Speer Mining Resource, Permit No. M-1983-176 <br />Class: General Correspondence <br />I have researched the permit file for M-1983-176 to ascertain the status of three (3) <br />structure agreements recently filed on September 19, 2002 by the operator. A113 <br />agreements were secured after approval of Amendment No. 1. (AM-1 was approved by <br />the Division on 09/27/2000). Review of the permit application and file for AM-1 <br />indicates 5 permanent man-made structures were identified in Exhibit S by the operator <br />as being within 200 feet of the affected land. An adequacy response letter dated <br />September 21, 2000 indicates the operator had secured agreements for 2 of the 5 structure <br />owners. These 2 agreements do not exist in the permit file; they appear to correspond for <br />item 2, 3, or 4 in the attached Exhibit S. The operator had also committed to a setback <br />distance of at least 200 feet for any structure until an agreement can be secured or an <br />acceptable stability analysis can be approved by the Division. The 3 agreements received <br />on September 19, 2002 correspond to Items I, 5, and 6 on the attached Exhibit S. Item 6 <br />pertains to additional structures not identified by the operator during permitting of AM-1. <br />See attached copy of Exhibit S. <br />In summary, the operator has provided structure agreements for Items 1, 5, and 6. The <br />operator may have agreements for Items 2,3, or 4 but they do not exist in the permit file. <br />If they do exist, it is likely they were not submitted to the Division for incorporation into <br />the permit file. <br />
