s+~ • • <br />Mr. Will Wright -2- April 5, 1982 <br />It is anticipated that the timeframes of the "lead" agency will govern any <br />review and approval process. It should be noted, however, that where a separate <br />and distinct approval document for some proposed activity is necessary from <br />each agency, it is Western Fuels' responsibility to obtain such approval prior <br />to the conduct of such activity. The purpose of this arrangement is to eliminate <br />duplicate correspondence, analysis, and review. It does not presume that one <br />agencies final approval document will substitute for the other agencies final <br />approval document. For example, where the Division approves a Technical Revision <br />to the permit, this approval will not necessarily substitute for the need to <br />obtain or modify a Temporary Use Permit from the BLM. <br />Inspections: Inspections will be conducted to ensure compliance by the <br />appropriate "lead" agency. It is the responsibility of the MLRD and the BLM <br />to coordinate with one another as necessary to ensure compliance. In general, <br />MLRD will conduct inspections within the permit area and BLM will conduct <br />inspections outside of the permit area. Joint inspections may be conducted as <br />necessary to ensure compliance. It is the responsibility of each agency to <br />forward copies of inspection reports to one another and generally keep each <br />other appraised of any problems. <br />Enforcement: Enforcement action will be taken as necessary by the appropriate <br />"lead" agency to ensure compliance. This does not, however, preclude either <br />MLRD or BLM from taking any enforcement action deemed necessary in accordance <br />with respective jurisdictions. Each agency will keep the other informed as <br />to the status of any enforcement action. <br />It seems that Western Fuels' need to have certain areas approved for "staging" <br />construction of the conveyor and railroad Loop should serve as a test case <br />for the working arrangement described above. Since the proposed activities will <br />be conducted within the permit area, the MLRD is the designated "lead" agency. <br />Western Fuels - Utah, Inc. should submit to the Division a request fora Technical <br />Revision to Permit No. C-018-81 and a request for amendment of the existing <br />Right-of-Way, then a request fora Temporary Use Permit. This concurrent <br />request should be made to the Division with at least 3 copies.
