The procedures for reducing the performance bond amount are the same <br />as those specified in Section 3.03.2 of the Regulations for seeking <br />release of all or part of a performance bond. This is a separate <br />procedure from that used for revisions and renewals. <br />a. An application for bond release or reduction needs to be <br />submitted to the Division. However, prior to submitting the <br />application, the permittee must send written notice of the <br />intention to seek a reduction or release of the bond to the <br />following parties: <br />i. Adjoining property ormers; <br />ii. Surface owners within permit area; <br />iii. Appropriate Local government bodies & municipalities, <br />i.e., County Commissioners, County Planning Department, <br />etc. <br />b. The application for bond reduction needs to include: <br />i. Copies of the above written notices.
