Notice of Termination of Jurisdiction <br />The landowner, Acacia LLC was notified ofthe Division's intent to terminate jurisdiction in a letter <br />inadvertently dated April 20, 2006 (correct date was Apri120, 2007). No comments from Acacia <br />LLC were received by the Division. <br />Post Mining Land Use <br />The private land holdings within the Coal Basin Mine are being developed by Acacia LLC for <br />commercial recreational uses. The Division does not have any authority to regulate the activities <br />occurring on the land now owned by Acacia LLC. <br />Completion of Final Inspection Required by Section 3.03.2(2) <br />The Division conducted a complete inspection on July 26-27, 2007. The inspection was conducted in <br />accordance with Section 3.03.2(2). The Division's inspection report is on file at the Denver and <br />Grand Junction offices and is incorporated by reference in this written finding. <br />V. SUMMARY <br />The Coal Basin site is apermit-revoked and bond forfeited site. Reclamation on the private property <br />previously owned by MidCon Realty, LLC was completed consistent with the statutory reclamation <br />requirements of the Colorado Surface Coal Mining Reclamation Act and in accordance with a <br />Settlement Agreement under the jurisdiction of Pitkin County District Court. The reclamation work <br />was completed under this Settlement Agreement and the termination of reclamation obligation is <br />provided in a Mazch 6, 2002 Notice from the Division and recorded with the Pitkin County Clerk <br />and Recorder's Office. No bond money remains for any additional work at this site. <br />VI. PROPOSED DECISION <br />In accordance with the previous Settlement Agreement and Notice, the Division proposes to <br />terminate jurisdiction on the private lands at the Coal Basin Mine. The Division finds that all <br />surface coal mining reclamation operations have been completed in accordance with the statutory <br />reclamation requirements of the Colorado Surface Coal Mining Reclamation Act and under the <br />Settlement Agreement resulting from Pitkin County District Court Case No. 97 CV 131-1 (Board of <br />County Commissioners v. Mid-Continent Resources, Inc v. MidCon Realty, LLC v. State of <br />Colorado). The Division gave notice on March 6, 2002, in accordance with the District Court <br />actions, that no further reclamation obligations due to past mining operations exist on the MidCon <br />Realty property described in Section I of this document. This Notice was recorded in Pitkin County <br />on March 21, 2002. No additional reclamation tasks were undertaken by the Division on that <br />property. This proposed decision terminates all of the Division's involvement for the private lands <br />within the Coal Basin Mine permit area. <br />6 <br />
