accordance with Rule 3.03.2 of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining and the Colorado Surface Coal Mining <br />Reclamation Act, CRS 34-33-101 et seq. section 125. <br />This proposed decision is to release from bond and liability all backfilling <br />and grading work which has occurred at the mine site to date, except for <br />grading done on the top of the mine bench and grading which needs to be <br />repaired at the base of the access road. Bond shall be retained in an <br />adequate amount to cover reclamation of sediment ponds and ditches, and the <br />successful establishment of vegetation; including soil preparation, seeding, <br />mulching, netting, and shrub transplanting, and other measures as described in <br />the approved reclamation plan. <br />This approval decision is based on an inspection of the site and evaluation of <br />reclamation results. The amount of bond to be released is $30,000.00. The <br />current bond of $110,000.00 shall be reduced to $80,000.00 when all statutory <br />notice and public comment requirements have been met. <br />Evaluation <br />All buildings, structures, and facilities at the mine site have been <br />dismantled and removed. Backfilling of the mine bench and grading of the <br />outslopes was conducted in accordance with the technical revision submitted <br />August 9, 1984. Certifications and monitoring indicate that the bench is in a <br />stable configuration. <br />Backfilling and grading of the access road was conducted in accordance with <br />the originally approved plan. <br />Grading work conducted in the riparian area below the bench and reclamation of <br />pond No. 1 was conducted according to plans submitted during the mid-term <br />review. These plans were approved July 3, 1986. Alternative sediment control <br />was approved for this area at the same time. Sediment control for this area <br />is effected by heavy straw mulch and netting application in order to promote <br />quick vegetative cover. <br />Grading on top of the bench was not conducted according to the approved plan. <br />Surveying and regrading of the bench top is necessary. Calculations for <br />regrading costs for the top of the bench are included in the following <br />section. Regrading of the base of the access road is necessary to repair ruts <br />created during clean-up operations. <br />All other areas of the mine site, including the area of the coal stockpile and <br />scales, have been graded according to the approved plan. The truck scale <br />facility along Highway 133 has been dismantled and the area regraded according <br />to the approved plan. <br />Reclamation work remaining to be done includes: regrading of the bench top, <br />regrading of ruts in base of access road, reclamation of sediment ponds No. 3, <br />No. 4, and No. 5, removal of the Hubbard Creek culvert. Clean-up of remaining <br />debris and discarded materials on site, and any measures necessary to achieve <br />-2- <br />
