Quincy <br />Topeka, KS 66612 <br />RE: Surface Owner Approval of Proposed Post-Mining Land Use; <br />Santa Fe Lease Nos. 166382 and 169568 Located in Trinidad, Colorado <br />Dear Mr. Spangler: <br />III IIIIIIIIIIIIIIII <br />999 <br />(3031 623-63 t 7 <br />twz 910-931-2561 <br />Over the past several years, Energy Fuels Mining Company (EFMC) has operated the Raton Creek Mine <br />and associated rail loadouts located in the vicinity of Trinidad, Colorado. As you may be aware, due to <br />adverse coal market conditions and various operational factors EFMC has filed a notice of permanent <br />cessation of operations with the Colorado Division of Minerals and Geology (DMG). In order to minimize <br />the potential for adverse environmental impacts and restore the effected lands to productive postmining use <br />EFMC proposes to reclaim all mining related site disturbance in accordance with plans presented in the <br />existing approved permit and in compliance with all applicable regulatory requirements. <br />Site reclamation of the subject lands will principally include demolition and removal of all facilities and <br />reestablishment of surface drainage patterns. Each of these activities are designed to protect the environment <br />and restore effected lands to productive postmining land use. <br />As a surface landowner, we recognize that proposed postmining land use is important to you. For the above <br />referenced rail loadout sites, proposed reclamation activities are designed to restore effected lands to a <br />postmining land use of industrial (coal loading facility). The proposed use is consistent with both the <br />premining use and existing land use plans and zoning designations. <br />If the proposed postmining land use is consistent with your desire and intent, please verify your approval by <br />your signature below and return one (1) signed copy to the following address: <br />Energy Fuels Mining Company <br />P.O.
