No. 7 <br />Page 2 <br />Components of the proposal that still need to be addressed to satisfy the requiremenOs of Stipulation <br />No. 7 are listed below: <br />1) Frequency of Sampling - BMRI proposes quarterly sampling. This item will be <br />.addressed in TR-19. As noted in the Division's December 18, 19991etter, quarterly <br />sampling is acceptable. However, regarding M~ replacement well, M-15 and SF-1, <br />the Division would prefer monthly sampling for a year. <br />2) Water Quality Monitoring - BMRI proposes to evaluate water quality based on a <br />statistical analysis. Here again, this item will be addressed in TR-19 (except for the <br />precambrian gneiss well). <br />3) Cessation of Water Quality Monitoring - BMRI proposes to continue monitoring <br />for a minimum of two (2} years after the hydraulic gradient has beep re-established <br />in the West Pit. At a minimum, 5 quarters of groundwater monitoring shall be <br />required prior to bond release. The 9-quarter monitoring period wily begin when the <br />surface of the permit area has been reclaimed and the hydraulic gradient in the west <br />pit is re-established. In addition, BMRI must submit documentation to substantiate <br />the claim that "the seepage velocity in the bacld-ill material will ragge from 699 to <br />2,049 feet per year". <br />4) Conditions That Will Trigger a Remediation Action or a Possible Vfiolation -This <br />item will be addressed in TR-19. <br />9) Commitment to Develop a Response Plan -This item will be addressed in TR-19. <br />As pointed out in James Stevens' December 18, 19991etter, an agreement must be aeached, at some <br />point, on the location of the M~ replacement well, SF-1 and M-19. This letter serves as an <br />agreement for the location of SF-1. <br />Your letter dated August 21, 1999, addressed the location of MAR. The Division is in agreement <br />with the location of MAR and, also, pursuant to the Division's letter of November 9, 1999, agrees <br />with the construction design plans, etc., of MAR. BMRI still needs to address the location, <br />construction design, etc., of M-19. Prior to February 2, 1996, BMRI should submit and receive <br />Division approval for a proposed location for M-19 monitoring well, as well as construction design <br />plans.
