Page E-4 contains the seed mix information, but the application rates do not specify that whether <br />it is expressed in pounds of pure live seed (PLS) per acre, or simply pounds of bulk seed per acre. <br />This detail will affect the revegetation establishment as well as the bond amount. Please clarify. <br />Exhibit G -Water Information (Rule 6.4.7) <br />The amendment is primarily intended to allow mining below the water table, which will include <br />the exposure of groundwater, which currently is not allowed. It is understood that until the proper <br />approvals are in place, from the Colorado Division of Water Resources (CDWR) or Water Court, <br />there must be no exposure of groundwater. If all other technical adequacy issues are addressed, <br />DRMS may issue a conditioned approval of this application, to allow such exposure of <br />groundwater after.gaining approval from CDWR, but the operator must forward to this office <br />evidence of such approval prior to any mining activity that impacts the groundwater. <br />Paragraph two of page G-1 contains a reference to the width or setback distance of the unmined <br />strip in which the siphon pipe is buried. This figure does not match that described in Exhibit D or <br />the cross-section D-D' on sheet C-3. Please clarify, making all references consistent and ensuring <br />that they meet the minimum requirement for geotechnical stability. <br />Exhibit L -Reclamation costs (Rule 6.4.121 <br />The summary of the costs appears to contain most of the necessary tasks. After the responses to <br />the technical items in this letter have been received, and/or any revisions are made based on <br />timely objections containing jurisdictional issues, this office will calculate the bond. <br />Other Items <br />All responses, revised materials or additions to this application which you send to this office must <br />be addifionally filed for public review with the county clerk and recorder. For all such materials . <br />please ensure that they are promptly filed and a receipt obtained for that additional filing. This <br />office must receive a copy of the receipt for all filings prior to the decision date. <br />Affidavit of Publication <br />Please provide a notarized affidavit of the four publications. This must be received prior to the <br />decision date. <br />Decision Date <br />The original decision date was set for 3/27/07. However this office received several timely <br />written objections, prior to the close of business on the last day of the public comment period <br />(understood by this office to be 3/1/07). As such, this office must automatically extend the <br />decision date and commence arranging the required "pre-hearing conference" and a hearing <br />before the Mined Land Reclamation Board (pursuant to Rule 1.4.9). The decision date is now <br />reset for 4/26/07. I have faxed you copies of the two objection letters and the two agency <br />comment letters. Today (3/2/07) another objection letter was received by the Division, but the <br />close of the comment period was 3/1/07, and this letter received today is not deemed timely <br />(pursuant to Rule 1.7.1). I have attached the late objection letter hereto, for your information. If <br />there are more objections or comments they will be forwarded to you. <br />Pre-ooeration Insnection <br />In the coming weeks I will contact you to arrange a time for a joint inspection ofthe site to <br />discuss the proposed operation. <br />I look forward to receiving the responses to this letter.
