Rosene ,Clerk of [he Board <br />when [he following proceedings, among others were had and done, to wit: Disision of Minerals and Geology <br />RESOLUTION NO. 2005-9- ~~ <br />A RESOLUTION TO AMEND THE LEGAL DESCRIPTION FOR THE GRAND GRAVEL <br />SPECIAL USE PERMIT AND TO ALLOW OPERATION OF A GRAVEL PIT <br />CONTAINING 21.21 ACRES ON CERTAIN PROPERTY LOCATED ON A PORTION OF <br />SE '/ SE Y SE'/< OF SECTION 1 AND THE NE '/ NE Y OF SECTION 12, T1N, R80W <br />OF THE 6T" P.M., GRAND COUNTY, COLORADO <br />WHEREAS, Resolution No. 2005-6-6 granted Grand Gravel a Special Use Permit for <br />expanded operations in a pre-existing 9.80 acre gravel pit, allowing an additional 9.57 acres <br />of operation to increase the total area used by the Permittee to 19.37 acres; and <br />WHEREAS, Grand Gravel, referred to as "Petmittee,"has made application for <br />amendment of the legal description for the Special Use Permit pursuant to the provisions of <br />Section XI of the Grand County Zoning Regulations, as adopted by the Grard County Board <br />of County Commissioners by Resolution No. 1974-11-4; and <br />WHEREAS, the legal description provided with Resolution 2005-6-6 was defective <br />and the corrected legal description is attached hereto as "Exhibit B," showing the total acreage <br />to be 21.21 acres; and <br />WHEREAS, a public hearing was held on said application on the 6'" day of <br />September, 2005 at 11:45 a.m.; and <br />WHEREAS, public notice was placed in a county newspaper of general circulation at <br />least twenty (20) days prior to the scheduled public hearing stating the time and place of the <br />public hearing; and , <br />WHEREAS, all property owners within 500' of the proposal were notified of the <br />scheduled public hearing at least twenty (20) days prior to the hearing date; and <br />WHEREAS, this Board has considered and studied the proposed amendment and <br />various other matters required by the Zoning Regulations; and <br />WHEREAS, this Board has considered the purpose of the Zoning Regulations, the <br />conditions of the surrounding neighborhoods and the county wide need for the use and has <br />determined that it would be in the best interests of the citizens of Grand County to issue the <br />Special Use Permit upon the terms and conditions which are hereinafter set forth; and <br />WHEREAS, this Board finds that there is an obvious public need for the gravel <br />operation provided for by this Permit, and that Permittee has provided proof satisfactory to <br />this Board that the permit site will be maintained during the Permit period. <br />
