Re: Technical Revision to Re-orient Mine Plan at the Eastside Mine

Dear Mr. Self:
We have received your technical revision application to revise your permit
(File No. C-84-063) to conduct coal mining in Colorado. Our initial review
indicates that all preliminary items required by the Colorado Surface Coal
Mining Reclamation Act, C.R.S. 34-33-101 et seq., have been submitted; thus
your technical revision application has been~emed complete for the purposes
of filing on the above date. All review and comment periods as provided in
the Act and Regulations promulgated thereunder initiate from this date of
filing.
A copy of the technical revision application, less any confidential
information, must be filed for public inspection with the Garfield County
Planner or Clerk and Recorder. Any subsequent changes or additions must also
be made in this copy.
The proposed newspaper aavertisement submitted with the application has been
found to be satisfactory with the exception that the legal description should
indicate that a portion of the permit area is located within Section 19,
Township 5 South, Range 91 West. You should commence publication of this
advertisement as specified in Rule 2.07.3.(2) of the Regulations with the
exception that the publication need only be run once, and reference to the
informal conference specified in Rule 2.07.3(2)(d) should be deleted. Proof
of the publication of the advertisement must be filed with the Division as
soon as available after the publication date.
The staff is currently reviewing your technical revision application to
determine whether the items you leave submitted are adequate in terms of
meeting the requirements for purposes of adequacy. You will be notified as to
the Division's findings of adequacy or inadequacy of your revision
application. The Division will render a proposed decision on or before
May 29, 1991.
