Lonp <br />Urvrswn Duenor <br />The Division has reviewed Colorado Yampa Coal Company's (CYCC) application for a <br />Technical Revision for retention of Pond M as a Permanent Impoundment. The Division has <br />also received comments from the US. Fish and Wildlife Service and the Colorado Office of the <br />State Engineer: Division of Water Resources. The following comments or concerns were <br />identified regarding this revision: <br />1) The Water Resources Division had no objection to the retention of Pond M as a <br />permanent Impoundment. However, the Division of Water Resources notes that a <br />livestock tank permit will need to be obtained from the Division Engineer's office. <br />2) The U.S. Fish and Wildlife Service projects that retention of Pond M will cause less than <br />100 acre foot water depletion, and therefore finds that no depletion fee is required for this <br />project, nor does the agency have any objections to the approval of this revision. <br />3) CYCC did not address [he final disposition of collection ditches M-l and M-3. Will <br />these two collection ditches remain as permanent? Please revise appropriate permit text <br />regarding the final disposition of these collection ditches. <br />4) CYCC did not provide an estimated reclamation cost specific to reclamation of Pond M. <br />Retention of Pond M would reduce [he reclamation cost liability associated with <br />reclamation of Pond M. Please provide estimated costs for reclamation of Pond M in <br />order for the Division to determine reclamation liability reduction. <br />5) CYCC is reminded that upon approval of Pond M as a permanent impoundment Rule <br />4.05.17 will need to be met.
