Minerals & Geology <br />1313 Sherman Street Rm. 215 <br />Denver, CO 80203 <br />Project No. 05-6371 <br />On behalf of Ken• Coal Company (Kerr), NWCC Inc. is submitting this request to change the <br />status of Pond F at the Man' Mine to permanent. Purpose of this document is to present a <br />demonstration to that end in accordance with the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining (Regulations) Rule 4.05.9 {13). <br />Kerr is making this request on behaff of the adjacent property owner, Silver Spur Land & <br />Cattle -Canadian River Ranches (Silver Spur), who has grazing rights on the portion of the <br />property sunounding Pond F. Ponds E, F and G have provided a consistent water supply <br />for the livestock, which are grazed through the area in the spring and early summer. The <br />land inGuding Pond E has been sold to another party making future access to that water <br />source unknown. In addition, Pond G is slated for re-grading and rGamation, which <br />eliminates a second source of water for livestock. If Pond F is made permanent, it would <br />continue to be a beneficial source of water during the time of year when this area is grazed. <br />A letter from Silver Spur indicating their interest in maintaining this pond is provided in <br />Attachment A. In addition, the Bureau of Land Management (BLM) has requested that <br />Pond F be retained for wildlife and livestock uses. A letter from the BLM in this regard is <br />also provided in Attachment A. <br />Pond F is situated on the northeast perimeter of the permit boundary in the NE%. SW/. <br />NEY. of the Section 26, Township 9 north, Range 78 West. It is located northeast of the Pit <br />1 footprint and serves as a sediment pond for that mined area as indicated on Figure 1. <br />The pond is charged by a small unnamed drainage and a diversion ditch PD-3. The pond is <br />located immediately on the south side of Jackson County Road (CR) 12E, which also <br />crosses the small drainage. The embankment is parallel to the county road and collects <br />runoff from a relatively undisturbed drainage area of approximately 63 acres. The pond has <br />also been charged by surface runoff from Pit 1 via ditch PD-3. The drainage area for Pit 1 <br />flows is approximately 60 acres. Kerr plans to retain ditch PD-3 as a permanent ditch. <br />Exhibit 29 in the permit includes the sedimentation pond designs for the mine.
