Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received the adequacy response prepared by Banks & Gesso, LLC. for Technical <br />Revision (TR-02) for the Lyons Quarry, Permit No. M-1977-208. The letter was in response to the <br />Division's adequacy comments dated June 30, 2003. <br />The revision request on-site disposal of concrete rubble at the close and demolition of the concrete <br />plant. The revised text and drawings state that the Smeade Ditch will be piped through the disposal <br />azea for a length of approximately 700 feet. The Division has a number of questions regarding the <br />piping of the Smeade Ditch; <br />Please inform the Division as to the owner(s) of the Smeade Ditch and the owner(s) of the <br />associated water rights within the Ditch. Because the Smeade Ditch will be altered and <br />conveyed under the concrete disposal site, CEMEX will need to obtain a notarized agreement <br />from the owner(s) of the Smeade Ditch and owner(s) of the water rights within the Ditch <br />concurring with the proposed relocation plan. Rerouting of the Ditch under the concrete <br />disposal site cannot be approved without consent from all owner(s) of the Smeade Ditch and all <br />owner(s) of the water rights within the Ditch. <br />CEMEX will need to provide a design demonstrating that the pipe redirecting the Smeade Ditch <br />under the concrete pile can beaz the maximum load of the concrete rubble and earth fill ranging <br />in height from 20 to 45 feet. In addition, please further describe the type of pipe to be used, size <br />of the pipe, length of the pipe, the location of the pipe in relation to the compacted clay liner, <br />grade of the pipe, inflow and outflow specifications of the pipe, and how it will be protected <br />during construction of the concrete fill pile. Please provide a new cross-section of the disposal <br />area to include the information noted above. <br />3. Please describe the anticipated flow rate associated with the Smeade Ditch.
