Bruce Hu p ie , i eral Program Supervisor
DATE: August 31, 1999
RE: Correction to statement made by the Division of Minerals and Geology
At the Informal Conference held in Buena Vista on August 27, 1999, concerning the proposed
conversion application to Permit M77-196, I misstated what the regulations require. I said that
[he applicant would need to provide the Division proof that the proposed reclamation plan for
industrial/commercial would be accomplished, or an alternate post mining land use and
reclamation plan must be provided. The effect being that the applicant would have two post
mining land uses and reclamation plans submitted for division review and approval. Rule
6.4.5(2)(b) of the Construction Material Rules and Regulations actually requires, "...In those
instances where the post-mining land use is for industrial, residential, or commercial purposes
and such use is not reasonably assured, a plan for revegetation shall be submitted;...".
I apologize for any
or confusion this may have caused.
