Bruce Hu p ie , i eral Program Supervisor <br />DATE: August 31, 1999 <br />RE: Correction to statement made by the Division of Minerals and Geology <br />At the Informal Conference held in Buena Vista on August 27, 1999, concerning the proposed <br />conversion application to Permit M77-196, I misstated what the regulations require. I said that <br />[he applicant would need to provide the Division proof that the proposed reclamation plan for <br />industrial/commercial would be accomplished, or an alternate post mining land use and <br />reclamation plan must be provided. The effect being that the applicant would have two post <br />mining land uses and reclamation plans submitted for division review and approval. Rule <br />6.4.5(2)(b) of the Construction Material Rules and Regulations actually requires, "...In those <br />instances where the post-mining land use is for industrial, residential, or commercial purposes <br />and such use is not reasonably assured, a plan for revegetation shall be submitted;...". <br />I apologize for any <br />or confusion this may have caused. <br />
