The Division is correct that the power company will be using the "Goat Trail" for access up <br />and down the hillslope. However, the conveyor corridor is also used for commercial <br />purposes. An above ground utility line, owned by Yampa Valley Electric, which provides <br />electrical service to the upper facilities is placed in that corridor making it, in fact, a <br />commercial utility corridor. The condor has been used by the power company to construct <br />the utility line and is anticipated to be used in the future to inspect and maintain the line. <br />Additionally, the assumption by the Division that relinquishing oversight "would result in <br />the deterioration of the reclaimed portion of the hillslope from lack of maintenance before it <br />has time to stabilize" is in error. Rule 4.15.10(2) states in part: <br />for azeas to be developed for industrial or commercial, or residential use <br />less than 2 years afrer regrading is completed, or less than 2 years after <br />approval of such use, whichever is later, the ground cover of living plants <br />shall not be less than required to control erosion. Final bond release shall <br />not occur prior to satisfactory cover establishment. <br />Therefore, P&M believes this issue should be considered to be resolved. <br />
