15. Lessor's Covenants and Warranties. <br />a. Lessor covenants and warrants and agrees to defend Tenant in the quiet enjoyment and <br />possession of the Leased Premises during the Term of this Lease, subject to the terms and <br />conditions hereof. <br />b. Lessor further represents and warrants to Tenant that Tenant shall have reasonable <br />exclusive access to the Leased Premises, as reasonably required for its operations during <br />such regulaz operation hours as are authorized by the Permits during the Term hereof, <br />subject to the terms and conditions of this Lease. <br />c, Lessor covenants to make all payments and perform or cause to be performed ail <br />obligations necessary to keep this Lease in effect, except as to those nonmonetary <br />obligations that are the duty of the Tenant hereunder. <br />d, Lessor warrants title to the surface, sand gravel, fill dirt and topsoil leased and agree to <br />indemnify and save Tenant harmless from all liability, loss or damage Tenant may suffer <br />as a result of claims, demands, costs or judgments against it arising by reason of any <br />defect in fitle. In the event that all or any part of the premises is encumbered by any lien, <br />the Lessor shall obtain a written subordination of any such lien or encumbrance to the <br />rights of Tenant hereunder, and upon failing so to do Tenant may declare this Lease <br />terminated. <br />16. Tenants Covenants and Warranties. <br />a. Tenant shall pay when due the Production Royalty and all other amounts due Lessor or <br />any third party hereunder. Amounts due Lessor that are not paid when due under the <br />terms of this Lease shall beaz interest at eighteen percent (18%) per annum. <br />b, Tenant shall conduct its operations on the property in a prudent and workmanlike manner <br />in accordance with good and accepted mining and business practices and in compliance <br />with all applicable federal, state and local laws, rules and regulations, including without <br />limitation those relating to safety, health and the environment <br />c. Tenant shall keep the Leased Premises free and cleaz of leins, chazges, claims or <br />demands arising from Tenant's operations hereunder and shall promptly pay for all labor <br />performed on the Leased Premises and for all supplies, materials, and equipment used or <br />placed on the Leased Premises. Tenant may contest in good faith any Lein; provided that, <br />Tenant shall not allow title to the Leased Premises or any portion of it to be lost. <br />17. Indemnification. <br />a. By Tenant. Tenant hereby agrees to hold Lessor harmless and indemnify Lessor and <br />Lessor's dtrectors, officers, employees, agents, representatives, and their respective heirs, <br />successors, and personal representatives,from and against: <br />
