signing this Lease in which to obtain the Permits. Tenant shall post any reclamation bonds or <br />undertakings required for such operations. Other permits specifically applicable to the <br />Asphalt Plant and Crusher or necessary for Tenant to operate the Asphalt or Crasher shall be <br />obtained by Tenant. Each Party shall fully comply a[ all times with those Permit obligations <br />and conditions applicable to that party's operations on Lessor's Property. <br />9. Records to be Keot. Tenant shall keep accurate records of quantities, nature and weights of <br />materials on which Producion Royalties aze due, which records shall be available for <br />inspection by Lessor at all reasonable times during business hours without unreasonably <br />disrupting Tenant's business operations. Production records shall be kept for a period of <br />three (3) yeazs after their creation. <br />10. Audit Cost. Lessor may cause an audit of Tenant's books and records to be made. For <br />purposes of verifying the amount of Production Royalty due to Lessor. All reasonably <br />necessary records shall be made available to Lessor or ifs agents for such purposes. The fees <br />of the auditors shall be paid by the Lessor, unless audit discloses an understatement of the <br />Production Royalty properly due the Lessor in excess of two percent of the amount of the <br />Production Royalty reported, in which event Tenant shall pay the fees of the auditors. <br />11. Tenant's Operation of Premises <br />a. Tenant shall use the Leased Premises only for mining, extraction and processing of <br />Sand and Gravel and the production and sale of asphalt products and storage and <br />maintenance of equipment and raw materials therefore, and shall not use the Leased <br />Premises, or permit them to be used for any other trade, business, manufacture or <br />occupation. All material produced by Tenant will be used specifically for Tenant <br />projects unless otherwise agreed to by Lessor. All material mined and crushed by <br />Tenant will become property of Tenant. Sale of this material by Lessor is prohibited, <br />unless mutually agreed by both parties. <br />b. Tenant shall be responsible for the proper disposal of all "waste" material created as <br />a by-product to the production of hot mix material. Tenant will be allowed to process <br />clean broken asphalt and concrete from offsite projects into recycled base for use in <br />construction projects. Tenant will pay Lessor a Production Royalty for any recycled <br />base that is removed from the property. <br />a Tenant shall not use the Leased Premises, or permit them to be used for any purpose <br />or use in violation of the laws or rules and regulations of any governmental body or <br />authority applicable to the Leased Premises. <br />d. All Provisions and revisions, amendments, expansions, or Modifications to the <br />Permits and Tenant's Permits aze incorporated herein and become part of this <br />agreement. <br />e. Tenant shall comply with all applicable federal, state and local laws, rules regulations <br />of government bodies and agencies regulating the Leased Premises and with all <br />
