<br />NOTICE OF PROPOSED DECISION <br />The Colorado Mined Land Reclamation Division has proposed to approve with <br />conditions an application for a revision (PR - 003) to the existing permit to <br />conduct coal mining and reclamation operations submitted by Western Fuels-Utah <br />for the Deserado Mine. <br />The revision will expand the permitted acreage by 1,320 acres, 1,000 of which <br />will be affected by underground mining. There will be no additional surface <br />disturbance. <br />The Deserado Mine operation is located in Rio Blanco County, approximately <br />10 miles from Rangely, Colorado. The mine is an underground operation with an <br />anticipated maximum production capacity of 1.3 million tons per year. The <br />coal to be mined is federal owned, and the surface to be affected is both <br />federally and privately owned. The revised permit area encompasses <br />approximately 10,856.7 acres in Townships 2 and 3 North, Range 101 West of the <br />6th Principal Meridian. _ <br />This proposed approval decision is based on a finding that the proposed <br />operation will comply with all requirements of the Colorado Surface Coal <br />Mining Reclamation Act, C.R.S. 34-33-101, et sec., and the regulations <br />promulgated thereunder. <br />Copies of the proposed decision including stipulations, are on file for public <br />inspection at the Colorado Mined Land Reclamation Division, Room 215, <br />Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and at the <br />Town Clerk's Office in Rangely, Colorado. Persons with an interest that may <br />be adversely affected by the proposed decision may request a formal hearing <br />before the Mined Land Reclamation Board on the proposed decision. Such <br />request must be made within thirty (30) days of the initial publication of <br />this notice, must be in writing, and must state with reasonable specificity <br />the reasons for the request and the objections to the proposed decision. <br /> <br />SLM/ern <br />5594G <br />
