NOTICE OF PROPOSED DECISION The Colorado Mined Land Reclamation Division has proposed to approve with conditions an application for a revision (PR - 003) to the existing permit to conduct coal mining and reclamation operations submitted by Western Fuels-Utah for the Deserado Mine. The revision will expand the permitted acreage by 1,320 acres, 1,000 of which will be affected by underground mining. There will be no additional surface disturbance. The Deserado Mine operation is located in Rio Blanco County, approximately 10 miles from Rangely, Colorado. The mine is an underground operation with an anticipated maximum production capacity of 1.3 million tons per year. The coal to be mined is federal owned, and the surface to be affected is both federally and privately owned. The revised permit area encompasses approximately 10,856.7 acres in Townships 2 and 3 North, Range 101 West of the 6th Principal Meridian. _ This proposed approval decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101, et sec., and the regulations promulgated thereunder. Copies of the proposed decision including stipulations, are on file for public inspection at the Colorado Mined Land Reclamation Division, Room 215, Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and at the Town Clerk's Office in Rangely, Colorado. Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made within thirty (30) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections to the proposed decision.
