WFC's response to this question addressed only part of our original question <br />(provided landowner consent and a list of all structures on site). Please respond to <br />the portion of the original question delineated in bold text, below. <br />WFC states that all structures on site will be retained permanently, asserting that <br />WFC is the landowner of the land upon which the structures reside, and that WFC <br />desires their permanent retention. WFC should provide a complete list of all <br />structures on site (as required by Rule 2.05.3(3)), provide a narrative detailing <br />continued compliance with Rule 4.04, and a description of the compatibility <br />of each structure with the approved postmining land use, as required by Rule <br />2.05.5(1). <br />2. Response accepted. <br />WFC did not respond to these comments from the Division's October 27~' memo: <br />3. This issue will be adrressed with Technical Revision No. 55. <br />4. DRMS usually includes costs for sediment pond cleanout during the ten yeaz <br />liability period, but this cost has not been included in the New Horizon cost <br />estimate since there is not adequate information to ascertain the current frequency <br />of pond cleanings. Please provide information on how often WRC is cleaning all <br />of the ponds on site. <br />5. WFC provided a fence diagram for Cut 88 (Map 3.02.2-3) showing reclamation of <br />the final pit at a worst case scenario. This diagram shows final contours of a 50' <br />deep, 500' wide channel, which would not be approximate original contour. <br />While this may be necessary for reclamation prior to completion of the life of <br />mine plan, DRMS is concerned that this would also be the case at any point from <br />Cut 88 to the end of the life of mine plan. Reclamation contours east of the <br />existing pit are up to 25' higher in elevation than premising contours, suggesting <br />that this may have contributed to the appazent deficit of material that now exists. <br />Please review the currently approved post-mining contours for the site and <br />determine if those contours can realistically be achieved. <br />
