Box 628 <br />Nucla, Colorado 81424 <br />Re: New Horizon Mine, Permit No. C-81-008 <br />Technical Revision No. 54 (TR-54) Adequacy Review <br />Dear Mr. Gubka: <br />The Colorado Division of Reclamation Mining and Safety (DBMS) has reviewed <br />Western Fuels -Colorado (WFC's) response to our November 13, 2006 adequacy letter <br />on Technical Revision No. 54. Based on that review, and our meeting with WFC <br />representatives on January 30, 2007 we have the following comments. All of the issues <br />contained in our November 13, 2006 adequacy letter have been resolved with exception <br />of the items listed below. All of the items below are related to the DBMS revised <br />reclamation cost estimate. <br />January 30, 2007 Meeting -numbering follows WFC meeting agenda <br />1. Drill hole reclamation -The Division has revised all drill hole and monitoring <br />well reclamation tasks, consistent with our discussions in the meeting and <br />subsequent information provided by WFC. The cost estimate now includes only <br />those holes which have not been reclaimed or mined through. With the exception <br />of wells N13, N16P1, N43, and N46 which will require positive displacement for <br />sealing, cost estimates for all holes are based on gravity placement (free fall) of <br />bentonite chips. <br />2. Dozer Job Correction Factors -Our comments on correction factors and the <br />Wyoming DEQ Guideline No. 12 are discussed in Item 1 of the General <br />Comments section below. <br />3. Scraper Capacity - <br />a.
