<br />Temporary Pond E As-Built and Reclamation Bond Estimate
<br />Dear Mr. Robens:
<br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph
<br />4, of the Colorado Revised Statutes, that on May 21, 1999, an application to revise coal mining operations at theSanborn
<br />Creek Mine was considered complete for the purposes of tiling. The revision was submitted by Oxbow Mining, Inc. All
<br />review and commen[ periods as provided in the Act and the Regulations ini[ia[e from this date of filing.
<br />This technical revision would approve the as-built certification and reclamation bond liability estimate For temprrary Pond
<br />E, which had been constructed as an emergency mine dewatering pond located adjacent to the North Fork of theGunnison
<br />River. The pond capacity is less than 2 acre-feet.
<br />The underground coal mining operation is on land located immedia[ely North of Somerse[. The permi[ area is further
<br />described as follows:
<br />Portions of Section 3l, Township 12 South, Range 90 West;
<br />Portions of Sections 34, 35 and 36, Township 12 South, Range 9l West;
<br />Portions of Sections 1, 2, 3, 4, 5, all of 6 and 7, Portions Nonh of the North Fork of the Gunnison River in Sections 8, 9,
<br />l0, portions of Sections I I, 12, and 17, Township 13 South, Rance 90 Wes[;
<br />Portions of Sections I-3, I1-13, Township 13 South, Range 91 West of the 6th P.M.
<br />The above-mentioned trac[s of land are shown on USGS 7.5 minute Quadrangle map of Somerset.
<br />A copy of the technical revision application is available for public inspection at the Delta County Courthouse, 5th & Palmer,
<br />Delta, CO 81416, and at the Division office. For addi[ional information or to provide written comments, contact the Division
<br />of Minerals and Geology, Room 215, 1313 Sherman Stree[, Denver, Colorado 80203, (303) 866-3567. In order for us to
<br />comply with regulatory time frames, we request that comments be submitted within fifteen (IS) days of this letter. If no
<br />comments are received by then, we will proceed on the assume[ion that you have no concerns wi[h, or objections to, the
<br />applicant's proposal.
