This letter will serve as a follow-up to our <br />conversation. On May 1, 2003 you faxed a letter to the Division of Minerals and <br />Geology (the Division) requesting a meeting on May 27, 2003. In your letter it was <br />unclear whether you wanted a meeting with representatives of the Division or if you <br />wanted to request a hearing before the Mined Land Reclamation Board to object to the <br />Division's proposed decision regarding the Southfield Mine Phase I bond release <br />application. <br />Representatives of the Division are available to meet with you on May 27, 2003. The <br />Southfield Mine files are public documents. At our office you would have access to the <br />files for the Southfield Mine to evaluate water-monitoring data, disposal certificates for <br />the petroleum contaminated soils and any other permitting information you are interested <br />in. <br />If you are requesting a hearing before the Mined Land Reclamation Board regarding the <br />Division's proposed Phase I bond release decision, the procedures in Rule 3.03.2 of the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining apply. <br />Rule 3.03.2(6) allows persons with a valid legal interest which might be adversely <br />affected by the proposed decision to request an adjudicatory hearing on the proposed <br />Decision of the Division. The request for a hearing must state with specificity the <br />reasons why the hearing is requested and must be received within thirty days of the first <br />publication of the Division's proposed decision. The Division's proposed decision was <br />first published in the Canon City Daily Record on May 1, 2003. The thirty-day comment <br />period will end on May 30, 2003. Therefore, the request for an adjudicatory hearing must <br />be submitted by May 30, 2003. <br />
