Townsend Avenue Michael B Lang <br />Montrose, CO 81401 Division D~re<~or <br />Re: Chimney Rock Mine (Permit No. C-81-023) <br />Permit Renewal Application No. 3 <br />Dear Mr. Clazk: <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 1 I8, <br />Pazagraph 3, of the Colorado Revised Statutes, that on October 1, 1997, an application to renew an existing <br />permit to conduct coal mining operations at the Chimney Rock Mine was considered complete for the purposes <br />of filing. All review and comment periods as provided in the Act and the Regulations initiate from this date of <br />filing. <br />The applicant proposes [o continue surface coal mining and/or reclamation operations on land located <br />approximately 22 miles West of Pagosa Springs, Colorado. The permit area is further described as follows: <br />Portions of Section 30, T34N, R4W, NMPM. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Chimney Rock. <br />The mine site has been reclaimed and no further disturbance is expected. <br />Because the above referenced permit renewal application might alter previously approved permit conditions or <br />mitigation measures, we ate requesting your agency's evaluation of the proposal. Your comments and concerns <br />relating to the adequacy of fish and wildlife resources information, the fish and wildlife plan, and the reclamation <br />plan as it relates to fish and wildlife considerations, including potential impacts to threatened or endangered <br />species, are requested. If wildlife habitat is the proposed postmining land use, we request your evaluation of <br />proposed woody plant stocking levels, planting arrangements, and methods for mitigation of potential adverse <br />impacts. <br />In order for us to comply with regulatory time frames, we request [ha[ comments be submitted [o the Division of <br />Minerals and Geology at the above address by 5:00 p.m. on. If no comments are received by this date, we will <br />proceed on the assumption that your agency has no concerns with or objections to the applicant's proposal. <br />
