resulting from an Abandoned Mined Land (AML) fees audit, outstanding civil penalties, <br />and a cessation order. The system reports that PCC allegedly owes an additional <br />$638,052.97 in AML fees in Kentucky, but that the audit results are under appeal. Civil <br />penalties from two notices of violation in West Virgginia are repportedly uncollected. The <br />notices were numbered 26:D007682:O:WV and 27:D007682:O:WV, and were apparently <br />issued on March 25, 1988. The system also reported that a cessation order was issued <br />at the Martwick Underground Mine (Permit No. 889-5005), a PCC operation in <br />Kentuc Until these issues are resolved, decisions to approve transfer the permits to <br />Seneca oal Company could not be finalized. <br />6. One additional concern we neglected to include in our previous correspondence was <br />rights of entry.
