The Phase I <br />bond release is for 2,247.7 disturbed acres. The surface is owned by private land owners and the <br />State; there is no Federal surface in this permit boundary; there aze 2,405.16 acres of Federal <br />minerals. <br />We have reviewed this Phase I Bond Release document and agree that Seneca Coal Company <br />has completed backfilling, re-grading and drainage control according to the approved <br />reclamation plan. A site visit to Seneca II was conducted on November 7, 2006 and a cursory <br />inspection of the reclamation was performed. <br />The proposed Phase I Bond Release for the 2,247.7 disturbed acres will not conflict with Federal <br />lease terms; therefore the Bureau of Land Management has no objection to the Phase I Bond <br />Release for this azea. We understand that bond funds will be released with this decision and that <br />the remaining bond amount is sufficient to reclaim the mine project.
