RE: Wyoming Fuel - Flume Monitoring Requirements
After reviewing Stipulation No. 14 of the Findings and the data submitted by
Wyoming Fuel Company (WFC), it is apparent that the operator has collected
sufficient data to satisfy the requirement of sufficient monitoring to
differentiate seasonal flow variations in Apache and Santisteven Canyons.
Monitoring can be discontinued after June 30, 1985 as requested.
A revision of the Stipulation is required to cover future proposed longwall
mining. The Stipulation will now read as follows:
Stipulation No. 14
Prior to secondary or retreat mining within 400 feet of the drainage basin
boundary of Pete Canyon, the applicant shall provide a description of stream
flow characteristics and water use in Pete Canyon.
The permittee shall also provide an assessment of the probable hydrologic
consequences of secondary retreat or longwall mining on the quantity and
quality of surface water in Ciruela, Apache, Santisteven and Pete Canyons.
The permittee will reinstitute surface water monitoring of Apache and
Santisteven Canyons prior to longwall, retreat, or secondary mining of these
canyons.
The Division is currently completing its review of WFC's Surface and Ground
Water Monitoring Reduction Revision. It is likely that Stipulations 12 and 14
of the approved permit will be combined to include all monitoring
requirements. Stipulation 14 will remain in effect as written above until
this change is made.
