Conversion Application OI (CN-01) <br />Objection by Sleeping Lion Ranch, LLC <br />importantly, in violation of Rule 6.4.7(4) King has not indicated a legal source of <br />water to supply the project water requiremeuts. <br />The Montgomery Letter suggests that King may intend to obtain water without <br />benefit of any decree of Water Court approval and instead rely on "free river" conditions. <br />A "free river" condition in the over appropriated Colorado River system only occurs, if at <br />all, during the spring run off. Such conditions will not exist for at least 10 months of the <br />yeaz. A mining operation cannot be permitted based on such an ephemeral water supply. <br />King seeks a massive expansion of its gravel mine from 10 acres to 341 acres. <br />King admits it will need water for dust suppression on a daily basis. King admits it does <br />not have a legal supply of water for that purpose. Even if King were able to change the <br />place and type of use and the point of diversion of its existing water rights, against <br />vigorous opposition by my client, King will never be able to change the season of use. <br />King will simply be unable to fill its 4,000-gallon water trucks outside of the historic <br />irrigation season. <br />The lack of water in this mining plan is a fatal flaw. Unless and until King <br />obtains a legal source of water to supply the pro}ect water requirements, the Application <br />should be denied. <br />Very tru <br />ichael F.
