The Ranches, Mr. Fisher (and his family) and Mr. Luppens (and his family) are collectively referred to herein as the "Ranch Owners.sl The Ranch Owners own private property in close proximity to the sand and gravel mine operated by King Mountain Gravel, LLC ("King Mountain") which is at issue in the above-referenced matter. We are writing on behalf of (1) the Ranches to request party status with respect to King Mountain's application for conversion of its Section 110 limited impact operations permit, Permit No. M-1978-314 ("110 Permit"), to a Section 112 reclamation permit ("112 Permit") (the "Permit Conversion Application"); and (2) the Ranch Owners to submit their opposition to the Permit Conversion Application. We appreciate the opportunity to provide these comments to the Colorado Mined Land Reclamation Board {the "Boazd") and your consideration of these comments.
