Lon1; <br /> Drvnion Dv¢clor <br />Enclosed you will find the Division of Minerals and Geology's Proposed Decision Form for Minor Revision No. 226 <br />at the West Elk Mine. <br />As stated on the Notice Of Intent To Construct Monitoring Holes prepared by MCC and submitted to the State <br />Engineer, testing and/or pumping shall not exceed a total of 200 hours unless prior written approval is obtained from <br />the State Engineer. If MCC plans to utilize the proposed pumping well to discharge Fluids beyond the stated time <br />limit, then a well permit from the State Engineer office may be required. In addition if the boreholes and piezometen <br />are utilized on a permanent basis, then an additional revision application will be required. The additional revision <br />will be required to update permit document maps and text [o include a description of groundwater discharge [o site <br />pond(s) for the purpose of dewatering mine site facilities. <br />Documentation must be submitted to the Division demonstrating that a copy of the approved revision application <br />was sent to the Office of Surface Mining and the Bureau of Land Management. The matenal should be sent within <br />15 days of final approval. <br />The estimated liability amount for Minor Revision No. 226 is $58,752.00; the reclamation cost estimate is enclosed. <br />If you have any questions, please contact me. <br />Sincerely, <br />i~u~uQ ~ ~~' <br />Michael P.
