~. . <br />Public Notice <br />The Colorado Mined Land Reclamation Division proposes to grant a partial <br />bond release for the Fruits Mine (File No. C-81-015) . The American Shield <br />Coal Company, operator of the mine, has requested that the Division release <br />the portion of the performance bond that is held for completing the <br />backfilling and grading in accordance with the reclamation plan. On <br />February 28 1991, a bond release inspection was conducted at the Fruits <br />Mine. The Division finds that the barkf;n;,,g and grading had been <br />completed in accordance with the approved reclamation plan. The Division <br />currently holds $40,000 and proposes to release 60$ or $54,000 in a phase 1 <br />bond release. The Division estimates that the *p~++a+*+der of the bond, <br />$36,000, will be sufficient to complete the remaining reclamation and to <br />abate any pollution of surface or subsurface waters. The Division's <br />performance bond calculations are available for public review at the Denver <br />Office. <br />A copy of the bond release request is available at the County Planners <br />office in Grand Junction and at the Colorado Mined Land Reclamation <br />Division office, 1313 Sherman Street, Room 215, Denver, Colorado 80203. <br />The description of the property is as follows. All underground workings and <br />surface facilities lie within TSS, R101W of the 6th P. M. in the NE 1/4 of <br />Section 30 and the NW 1/4 of the NW 1/4 of Section 29. The parcel of land <br />in question is located on the U.S.G.S. Ruby Lee Reservoir 7.5 Minute <br />Quadrangle in Mesa County. <br />Written comments, objections and request for an adjudicatory hearing, must <br />be received by the Division within 30 days of the first publication of the <br />proposed decision by the Division. The request must state with reasonable <br />specificity the reasons for the request and objections to the proposed <br />decision. <br />1 <br />
