At this time, we <br />aze requesting additional time beyond the September 6, 2005 deadline to complete the <br />submittal of this information. As you are awaze, Xcel Energy has been slow to assist us <br />with our Rule 6.3.12 compliance. To date, we have returned a letter of agreement to Xcel <br />Energy and aze awaiting their submittal of the completed agreement to the Division. <br />Pursuant to Rule 1.6.2(1)(b), we have posted the required notices at the access <br />road to the mine site. We have also submitted the amendment application and all related <br />items with Boulder County. <br />At this time, an additiona130 day extension to complete the AM-2 application <br />would seem adequate. <br />Thank you for your attention to this matter.
