Box 289 <br />Sturgis, Kentucky 42459 <br />RE: Reversal of Previous Denial Decision and Proposed Decision to Approve Permit <br />Renewal RN-02, Apex No. 2 Mine, File No. C-S1-011 <br />Dear Mr. Harman: <br />Enclosed you will find the Colorado Division of Minerals and Geology's Proposed Decision <br />Package regarding the renewal of a valid, existing permit for the Apex No. 2 Mine (our <br />permit No. C-81-011). The permit is for reclamation activities only. The Apex No. 2 <br />Mine, operated by Sunland Mining Corporation, is approximately 6.5 miles northwest of <br />the town of Oak Creek along Routt County Road 29 and is located in Sections 21 and 22, <br />Township 4 North, Range 86 West of the 6th P.M. in Routt County. <br />The application for permit renewal was initially denied on April 28, due to an OSM <br />Applicant Violator System denial recommendation. This decision was rescinded because <br />the unpaid AML fees owed to the Office of Surface Mining have been paid. <br />Notice of the proposed decision will be published in the Steamboat Pilot on May 13 and <br />May 20, 1993. The first publication will initiate the thirty day public comment period for <br />the Division's decision.
