Long <br />Division Director <br />Upon review of your November 19, 1997 faxed response to the Division's fourth adequacy review letter, <br />it has been determined that all concerns have been adequately addressed. Therefore, Amendment No. 1 <br />is adequate for approval. The reclamation cost estimate was recalculated for the reduced topsoil <br />replacement area indicated on the revised maps. The resulting task sheet and summary form are <br />enclosed. Please replace the old summary form, task no. 5, and task no.7 worksheets, in the estimate <br />mailed to you on November 18, 1997, with these revised forms. The application is approved, as of this <br />date, with a required financial warranty amount of $22,088.00. Delta Sand and Gravel Company must <br />submit a financial warranty in this amount within sixty (60) days of the date of this letter. <br />The proposed stipulation to restrict mining to 200 feet away from the railroad will not be imposed by the <br />Division because the operator has made a commitment, in the application, to restrict excavation of <br />gravel to areas further than 200 feet from the railroad. <br />Please ensure that no disturbance of the new permit area occurs until the required financial warranty is <br />submitted to, and approved by the Division. <br />If you have questions or need additional information, please contact me at our Durango Field Office, 484 <br />Turner Drive, Building F, Suite 101, Durango, Colorado 81301, phone no.
