Box 70 Loma, Colorado 81524-0070 RE: Insurance Certificate McClane Canyon Mine (Our file #C-80-004) Dear Mr. Walters, Enclosed, please find a copy of Salt Creek Mining Company's liability insurance policy furnished by Ms. Lee Ann Brake of McGriff, Seibels & Williams, Inc. Regarding the insurance coverage for the McClane Canyon Mine, I would like to reiterate our telephone conversation of this afternoon. On November 26, 1991, the Division received a copy of the insurance policy issued to Colorado-Ute Electric Association. The certificate has been found to be inadequate in terms of the requirements set forth in Rule 2.03.9(1) of the Rules and Regulations of the Colorado Mined Land Reclamation Board for coal mining. The policy is a "claims-first-made" policy, with an aggregate limit of thirty-five million dollars. Endorsement 1, the "named insured" section of the policy, lists a number of Colorado- Ute Electric Association operations, including Salt Creek Mining Company. The concern of the Division is that should claims at any one of the operations listed in the endorsement exceed the aggregate limit of the policy, other operations covered by this policy would then be uninsured. The Division is in need of either an endorsement to the current policy which clearly states that each operation has adequate coverage independent of other named operations, or a separate policy for each permitted operation.
