Lang <br />Division Dneaor <br />During the last two days, the Division and J.E. Stover, consultant to Bear Coal Company, <br />have negotiated a final reclamation bond amount for Bear Mine No. 3. The amount agreed <br />upon by both the Division and Bear Coal Company is $145,000.00. Calculations will be <br />forwarded to you shortly. <br />Bear Coal submitted, on July 12, a request for formal board hearing contesting the Division's <br />calculated bond amount of $134,073.00 (total direct rechunation costs), approved through <br />TR-11. The total bond amount proposed by the Division including indirect costs was <br />$174,013.00. $4,339.00 was subsequently added as approved by TR-12 (screen plant). <br />Bear Coal requested the hearing to dispute three tasks listed in the bond, where large <br />discrepancies existed between the Division's calculations and Bear Coal's calculations. <br />The tasks are summarized in a Division memo from Susan Morrison to Steve Shuey on <br />May 18, 1993. The memo was included in the June 4, 1993 TR-11 partial approval letter <br />from the Division to Bear Coal. Tasks lla, l lc, and 12 from that memo regarding <br />structural demolition and revegetation are the three disputed tasks mentioned above. <br />~II ~I~~II~II~~~~ ~II <br />STATE OF COLORADO <br />
