The revised B-seam mine plan and the results of subsidence analyses as well as <br />the subsidence monitoring surveys, current outcrop subsidence response above the existing <br />berm, surface crack mapping and outcrop monitoring all indicate no need for the additional <br />berm work. Additionally, D-Seam panel WD1 has been completely mined and panel WD2 is <br />over 30% complete so virtually all of the subsidence has occurred along the outcrop above the <br />mine facilities with no rockfall response. <br />The same logic holds true for the Miley residence. BRL's analysis of the subsidence data <br />indicates the Miley residence is not in any danger from rockfall initiated by mining activities. <br />However, the Miley residence is located below fractured sandstone outcrops that pose natural <br />rockfall risks. BRL intends to construct a rockfall protection berm above the Miley residence to <br />mitigate the natural rockfall risk. BRL's motive for this action is to protect the residence. <br />Additionally, if the berm is not constructed and a natural rockfall event damages the residence, <br />the natural rockfall event might erroneously be interpreted as a mining related rockfall event <br />which could create problems for BRL. <br />Since, the rockfall protection berm will mitigate natural rockfall risks and will be a permanent <br />structure, BRL requests that it be allowed to construct the rockfall protection berm outside of <br />the purview of the DMG. BRL would like to construct the Miley residence rockfall protection <br />berm during October 2004. <br />Please call if you have any questions. <br />Sincerely, <br />J.
