Binns
Environmental Protection Specialist
Division of Minerals & Geology
1313 Sherman St., Room 215
Denver, Colorado 80203
RE: Eagle No. 5 and 9 Mines (Permit No. C-81-044)
Technical Revision No. 25
Dear Ms. Binns:
pF' Cpl
.e
rr~
Ray Romer
Cgvemor
)amen 5. Lochhead
Executive Director
Hal D. Simpson
State Engineer
The referenced request for approval of a technical revision involves drilling a 6-1 /4 inch
borehole to a depth of 2,150 feet in Section 30, Township 6 North, Range 91 West, 6th P.M.
Originally it was proposed that said borehole would be steel-cased and grouted at appropriate
intervals to prevent commingling of aquifers. However, in a letter dated November 16, 1994, Mr.
Marcus Middleton of Cyprus Empire Corporation stated that the borehole would be abandoned.
It was estimated that from site preparation to abandonment of the borehole would take no more
than '10 days.'
The following concerns or comments are provided for your consideration:
1) This office is concerned that if a confining layer is encountered, that sufficient precautions
will be taken to assure formational fluids are not allowed to migrate from one formation to
another.
2) Any produced ground water cannot be put to beneficial use without a valid well permit.
3) Plugging requirements should assure maintenancellhydraulic integrity and water quality of
any aquifers encountered.
I assume that rules and regs of DMG will address the above concerns, since statute and
Rule 3 of the Revised and Amended Rules and Regulations of the Board of Examiners of Water
Well Construction and Pump Installation Contractors (August 1988) specifically excludes
boreholes for mineral exploration from said Rules and Regulations.
Sincerely,
~~'v,~CV~~~~~
Chuck Roberts
Professional Engineer III
CR:jmg
6144L.cr
