Environnrenta[Consultants, /nc.
August 7, 2000
Mr. Kent Gorham
Senior Environmental Protection Specialist
Division of Minerals and Geology
215 Centennial Building
1313 Sherman Street
Denver, CO 80203-2273
RECEIVED
AUG 14 2000
Divisional Minerals a Geol°9Y
RE: Response to Comments, Culvert Extension/Removal, MR-82
New Elk Mine (Permit C-81-012)
Dear Mr. Gorham:
11111111NIIIIlllll
Picketwire Processing, LLC hereby submits three (3) copies of the attached revised materials for
response to comments on the above Minor Revision in your letter dated July 5, 2000.
In regards to Culvert C49, the Division is correct that the culvert is on a road to the location of the
West Portal water tanks and it was installed as a pre-law structure. When the mine was permitted
in the early 1980s, however, the water tanks and culvert were not included in the permit document
because this was an inactive area and has remained as such since the permit was issued, with
exception of Wyoming Fuel Company's self-directed cleanup efforts to eliminate potential hazards
in the West Portal area. Culvert C49 was not added to the permit until 1993 when the flurry of
NOVs were issued at the mine. Picketwire feels that adding the culvert at that time was an error.
However, rather than continue to argue with the Division over this culvert, we have added it back
into Map 14 and Table 21 (page 2.05-14a) and it will be reclaimed as future activities progress on
this inactive portion of the property.
As for the small subsidence area above the West Portal main entry, Picketwire hereby withdraws
the idea ofextendingculvert C-24 over the entry slope area to prevent infiltration of water. Instead,
we propose to monitor subsidence in the area and repair as necessary. Picketwire wil I fence the area
to prevent human or wildlife access for safety reasons and, depending on the situation at final bond
release, may retain the fence as a permanent structure. The fence will be afour-strand barbed wire
with steel posts measuring approximately 50 by 50 feet. Map 14 has been revised to show the
location of the fence.
5231 South Quebec Street • Greenwood Village, Colorado 801 I I '
Phone (303) 850-0930 • Fax (303) 721-9298
Web Site: www.greystone-consultants.com • [:-mail: greystone C~greystone-consultants.com
