Gunnison No. 1 <br /> File No. C-007-80 <br />Dear Ms. Beville: <br />~~~~ y <br />The Division has completed its review of your application to remove 320 acres <br />from the permit area. We have identified one concern which should be resolved <br />before we can propose a decision. <br />It appears that Bear Coal Co., and West Elk Coal Co. are proposing overlapping <br />permit areas with a common area of potential subsidence effects. The area in <br />question is N/2 N/2 N/2 NE/4, NE/4 NE/4 NE/4 NW/4, Section 20 and S/2 S/2 S/2 <br />SE/4, SE/4 SE/4 SE/4 SW/4 Section 17, and a wedge in the far southwest corner <br />of Section 16, T13S, R90W of the 6th P. M. <br />We have alerted Bear Coal Co. to this concern also. We are requesting that <br />you and Bear Coal Co. strike an agreement detailing who shall be responsible <br />for any subsidence effects in these areas. <br />This agreement needs to be made prior to November 18, 1985 so as not to delay <br />approval of pending revisions.
