(Kaiser), the following information is <br />provided iri response to your (DMG) letter of April 16, 1996. A revised Exhibit 7, Sediment <br />Control Design Criteria, is enclosed which addresses your comments as discussed below. <br />DMG letter subparagraph l: <br />1. .Rule 4.05.6(I1)(f) requires the combined upstream and downstream slopes of the settled <br />embankment not be steeper than Sh:ly, with neither slope steeper than 2h:ly. Currently, <br />according to We as-built drawings in the permit document, Ponds 2,. 4, & 5 do not meet this <br />requirement. These may be approved if the Division is provided appropriate analysis that the <br />embankments aze stable. <br />Response: <br />Kaiser submits this relevant information showing that the embankments, as constructed, are stable: <br />a. Stability over time <br />The as-built drawings of 7-7-91 (Revisions 1) appazently depict the embankments as <br />originally constructed (some spillways were modified after construction and before July 7, <br />1491): No quarterly inspection reports provide an indication of slope instability (or <br />potential failure) to date. <br />b. Temporary structures <br />The embankments (sedimentation ponds) aze temporary structures and are not proposed <br />for retention in the reclamation plan. The structures aze nearing the end of their <br />functional purpose. Kaiser plans to submit a Phase II Bond Release Request for the <br />reclaimed lands during calendaz year 1996..
