letter from Harry Posey (DMG) to Bob Hill in the AM-02 application. This means the percolation rate will be one
millionth of a cm/sec or less. The Division will not approve a permeability of 10 or 106 cm/sec. We must insist
that the figure stated in my last letter (as approved in 1995) remain as the requirement. Please confirm that you
intend to commit to the permeability rate previously approved for AM-02 in 1995.
Finished Slope Gradient
Your response states that final slopes will be 34 degrees, which is about 1.5 (horizontal):1 (vertical). This will be
the maximum slope gradient of the outslopes of fill material. The gradient should be less wherever possible, to
maximize stability.
Reclamation Plan
The question of where topsoil will be applied is answered by your response (though I agree that it is a bit
confusing). An additional map (when Mr. Bond can provide updates) showing where topsoil will be applied would
be helpful. No further information here is needed.
Your response confirms that the topsoil depth, seed mix and seeding rate, are to be unchanged from those details
previously approved in the file. No further information here is needed.
Post-Mining Land Use
The conflicting information about the post-mining land use in this amendment application has been clarified: you
stated that it is to be "forestry." No further response is needed.
New Mill Building Location and Permanent Status
The new location of the mill building will be approved. Since the mill building is to be a permanent structure and
remain onsite after reclamation, the reclamation cost of removal of the building will be deleted from the list of
reclamation items.
New Acrea¢e to be Added to Permit
The new area, consisting of 0.67 acres below the southern end of the permit, will be approved to be added to the
permit area.
Amendment Mans
You stated that you would try to obtain updated, complete maps when it becomes possible to contact your
geologist, Brian Bond, which would be appreciated. As stated in my previous letter, the maps aze adequate for
purposes of this amendment, and no additional maps aze required at this time.
When you discuss updating the maps with Mr. Bond, the features most important to include are all the roads, adits
and buildings. Each should be depicted, with a notation as to the status of each (such as, if it is being maintained, if
it is actively mined or being reclaimed, if it is closed or open, etc.). This will become information that can be easily
updated each year.
Filing Additional Amendment Application Material
You have provided a receipt for the additional materials that were filed with the clerk and recorder. Please be
reminded that the next response (to this letter) will constitute additional application materials, and must also be
filed with the clerk and recorder. Again, please obtain a receipt for the filing and submit it to this office.
I look forward to receiving your responses. Please do not hesitate to contact me if you have questions. You should
send your responses directly to me at the Division's Durango field office: 701 Camino del Rio, Room 125,
Durango, CO 81301; telephone 970-247-5143 or fax 970-247-5104.
Cont.
