STEVENS <br />OPTION TO LEASE GRAVEL PROPERTY <br />AND RIGHT OF FIRST REFUSAL <br />THIS OPTION TO LEASE GRAVEL PROPERTY AND RIGHT OF <br />FI T REFUSAL (herein called "this Option") dated this fg day of <br />1449. <br />1. In consideration of the <br />the undersigned Margaret V. Morton, Robert J. Stevens and Larry L. <br />Stevens whose mailing address is P.O. Box 693, Fort Lupton, Colorado 80621, and <br />whose street address is 11778 Highway 52, Fort Lupton, Colorado 80621 (herein <br />collectively called "Grantors"), for themselves, their heirs, personal representatives, <br />successors, and assigns, hereby give and grant unto Mobile Premix Concrete, Inc., a <br />Colorado corporation (herein called the "Company"), its successors and assigns, the <br />exclusive right and option to lease for aggregate, concrete and asphalt batch plants and <br />for the extraction of stone, sand and gravel and other materials as hereinafter <br />identified, at the royalties, for the term, and upon subject to all of the other terms and <br />conditions set forth in the form of lease (herein called the "Lease") attached to and <br />made a part of this Option, all of that real estate (the "Property") situate in Weld <br />County, Colorado, described in Exhibit A attached to the Lease and by this reference <br />made a part of this Option. The materials which are the subject of this Option and the <br />Lease are referred to herein as "Materials" and are stone, sand and grave] and any <br />overburden and valuable solid minerals, other than hydrocarbon minerals such as coal, <br />oil, gas and associated liquid hydrocarbons, that are removed incident to sand and <br />gravel operations hereunder and which are saleable and recoverable in the course of <br />such operations. <br />2. Grantors acknowledge that they have received from the Company the, <br />foregoing sum as inrt ai 1 <br />consideration for the granting of this Option. In order to maintain this Option in <br />effect, Company shall pay Grantors further collective <br />ayable on or before the end of the <br />5 day of each month.
