In addition, the DOW recommends seeding un-mined azeas with a native grass and fort <br />mixture that has high forb contort to potentially benefit by encouraging continued use of the <br />area bysage-grouse. Rule 3.1.8(2) encourages operators to contact the DOW and/or other <br />federal agencies with wildlife responsibilities to sec if any unique opportunities are available <br />to enhance habitat and/or bmefit wildlife which could be accomplished. Such inter-seeding <br />un-maned areas within the permit area could potentially benefit the sage-grouse in the <br />surrounding arm. Please respond to this proposed mitigation, sad revise the application <br />accordingly. <br />4, Sedimentation :wd Erosion Control Plan: The applicant states that because ofthe change <br />in the mining plan, there are locations on the east side of the pit where stotmwater could <br />potentially flow out of the pit down Utc existing drainages. The applicant will provide <br />temporary erosion control measures in the form of diversion ditches, silt fences and straw <br />bales within and along the pit edges to ensure that all stormwater is diverted into the pit <br />Please be aware that a CDPS stomrwater permit tray be required for such activity. In <br />addition, please locate on the map where these erosion control features will be installed. <br />5. Comments from the Office of the State Engineer: The OSE provided written comments <br />regarding the application. A copy of the letter is attached for your review. Please respond to <br />their comments accordingly. <br />Please be advised th:u ICiag Mountain Sand & Gravel Pit Conversion Application maybe <br />deemed inadequate, :end the application maybe denied on March 15, 2005 unless We above- <br />mentioncd adequacy review items are addressed to the satisfaction of the Division. if you feel <br />more time is needed to complete your reply, the Division can grant an extension to the decision <br />date. This will be done upon receipt of a written waiver of your right to a decision by Marsh I5, <br />2005 and rsqucst for additional time.
