Box 70 <br />Loma, Colorado 81524 <br />RE: McClane Canyon Mine (C-80-004) <br />Permit Revision ~1 <br />Performance Bonds <br />Dear Mr. Walters: <br />The Division recently proposed to approve a permit revision to <br />include a new federal coal mining lease at the McClane Canyon Mine. <br />Although the decision by the Division will be final at the close of <br />the public comment period, the Office of Surface Mining has not yet <br />approved revisions to the mine plan. Please be aware that prior to <br />initiating mining activities in the new lease area, Salt Creek <br />Mining Company must receive approval of its mine plan from the <br />Office of Surface Mining. .The Office of Surface Mining has <br />indicated that the following amendments to performance bonds <br />currently held by the Division are necessary for their approval of <br />the mine plan: <br />1. The legal description of lands secured by the performance <br />bond must be changed to reflect the increase in permitted <br />acreage. <br />2. The bond document must include the statement: "Upon <br />termination of the Cooperative Agreement entered into between <br />the State of Colorado and the Department of the Interior, all <br />bonds shall revert to being payable only to the United States <br />(OSMRE) to the extent that Federal lands are involved." <br />The Division has recently prepared forms for the amendment of <br />bonding documents, which should arrive at your office soon. <br />If you have questions or are in need of additional information, <br />please contact Janet Binns. <br />Sincerely, <br />Susan L Morrison <br />Reclamation Specialist <br />cc: Janet Binns, MLRD <br />
